PEXA Integration

Property Exchange Australia (PEXA) is an electronic settlement platform that has revolutionised the conveyancing process. Since February 2023, it’s mandatory in Queensland to settle all conveyancing matters via PEXA. The benefits include:
  • Efficiency: No more physical collection of bank cheques or signing of transfer documents; everything is done electronically.
  • Speed: Immediate electronic registration of the property into the buyer’s name post-settlement, eliminating the 4-6 week wait.
  • Convenience: Conveyancers can manage the entire process from their computer, facilitating quicker communication with financiers.

The Conveyancing Process: Selling and Purchasing

Appointment of Conveyancer:

At BWJ Law, we recommend appointing one of our experienced conveyancers as soon as you decide to sell. Having a conveyancer ready beforehand can be beneficial for anticipating your contract and ensuring a smooth transaction.

Contract of Sale:

Once you accept an offer, you’ll sign a Contract of Sale. The real estate agent then sends this contract to your conveyancer at BWJ Law. We will meticulously review the contract to ensure all terms are in your best interest.

Your dedicated conveyancer will inform you of all critical dates and actions required, which may include:

  • Completing necessary client paperwork.
  • Signing and lodging a Discharge Authority if there’s a mortgage on the property.
  • Providing continuous updates and clear communication throughout the process.

When purchasing a property, the process can begin even before you make an offer. Here’s how BWJ Law can support you every step of the way:

Appointment of Conveyancer:

At BWJ Law, we advise appointing a conveyancer before making an offer to review the contract and advise you on your obligations. However, it’s also acceptable to appoint one after signing a contract. Our team is ready to step in at any stage to ensure your interests are protected.

Contract of Sale:

Once your offer is accepted, you’ll sign a Contract of Sale, which is then sent to your conveyancer at BWJ Law . We will carefully examine the contract to ensure compliance with all legal requirements and your best interests.

Key Responsibilities:

Your conveyancer will guide you through critical dates and necessary actions, including:

  • Completing required client paperwork.
  • Coordinating with your financier if you need a mortgage.
  • Arranging building and pest inspections.
  • Ensuring insurance coverage for the property from the agreed date.
  • Assisting with the payment of stamp duty to the Queensland Revenue Office (QRO). The amount depends on the property price and its intended use (residential or investment). Use the Transfer Duty Estimator for calculation.

Serena has previous experience as a Barrister’s Assistant in family law as well as working in a mid-tier commercial law firm in property law, wills and estates, employment law and construction disputes. This experience has provided her with the opportunity to learn from an array of senior legal practitioners before choosing to specialise in family law.

Serena is passionate about ensuring her clients feel well informed throughout their matter. Serena acknowledges every personal circumstance is unique and no other person knows exactly what it is like to walk in your shoes.

Michael was awarded a Bachelor of Laws with Honours from QUT in 2012, and was admitted as a lawyer in 2013. 

He also has a Bachelor of Science from UQ which he was awarded in 2007 (before deciding that a career in law would be more interesting than science).

Michael has practiced exclusively in the areas of Family Law, Child Safety (Care and Protection), and Domestic Violence since mid-2014. 

Michael has experience as a Separate Representative for children in Child Safety cases and has appeared on behalf of hundreds of people in Family Law and Domestic Violence cases in Queensland and the ACT.

Michael’s experience means he has a particularly keen insight into how to best avoid Court and he has an excellent record of settling cases quickly and without unnecessary conflict and cost. 

That said, he also knows how to best prepare and conduct litigation if Court becomes unavoidable, and he will expertly guide you through even the most complex and delicate case.

Michael takes a genuine interest in his clients and will make sure that you are properly advised in a way that is easy to understand, without all the unnecessary jargon that so many lawyers love to use. You can trust Michael to be direct, flexible, and empathetic. 

When he is not at work, Michael loves being in the outdoors, whether that’s fishing from his kayak or working in the garden. He also loves to cook and experiment in the kitchen.
